Privacy & Data Protection Policy
For the purpose of this Contract (the “Privacy & Data Protection Policy’ Contract”), the following definitions are used:
- the terms (the “VTC Company”, “Company”, “Author”, “We”, “Us” or “Our”) shall mean ‘VANITIN Three Commas Private Limited’, incorporated on Date August 23 2018, in India, with the Company Identification Number U93090HP2018PTC007126, and include, without limitations, its respective successors and permitted assigns. Authorized Signatory & one of its Directors, Mrs Vani Sardana, has an alternate Business Address at: #C-35, 2nd Floor, Lane 2, Sector 1, New Shimla, Shimla – 171009, Himachal Pradesh, India. The Company now has its Headquarters in the UK and a Research Office in Switzerland.
- the term (the “VTC Community”) shall mean VANITIN Three Commas Private Limited, its shareholder(s) or owner(s) or director(s) or employee(s) or agent(s) or licensor(s) or third-party supplier(s), and include, without limitations, their respective successors and permitted assigns.
- the term (the “VTC Site”) shall mean the Website located at (https://forexalgos.com, and any sub domains), and owned by the Company, VANITIN Three Commas Private Limited, regardless of how you access or use it, including through Desktops, Laptops, Tablets, Mobile Phones, or any other device.
- the term (the “VTC Services") shall mean any Information, Content, Products, White Papers, Industry Reports, Articles, Editorials, eBooks, Research related Content, Offers, Memberships, Subscriptions, Services, Recommendations, Suggestions or Advice, collectively, within the Website located at (https://forexalgos.com, and any sub domains).
- the terms (the “You” or “Your”) shall mean You, the viewer(s) or user(s) or subscribers(s) or members(s) or client(s) or licensee(s) or buyer(s)/beneficiaries(s) of “VTC Site” or “VTC Services", and include, without limitations, their respective successors and permitted assigns.
- the term (the “ForexAlgos’ BlackBox”) shall mean the AI Robotic Trading System/Strategy that generates defined set of trade signals for further use, developed by the Company VANITIN Three Commas Private Limited, and provided as one of its available Services, through the Website (https://forexalgos.com, and any sub domains).
In this ‘Privacy & Data Protection Policy’ Contract, unless the context requires a different interpretation:
- the singular includes the plural and vice versa.
- references to sub-clauses, clauses, schedules, or appendices are to sub-clauses, clauses, schedules, or appendices of this ‘Terms & Conditions Of Use’ Contract.
- a reference to a person or user includes any person(s), user(s), firm(s), company or companies, government entity or entities, trust(s) and partnership(s).
- "including" is understood to mean "including without limitation".
- reference to any statutory provision includes any modification or amendment of it.
When you visit or access the VTC Site, and/or use the VTC Services provided through the VTC Site, and/or successfully signed up as user/member, or ForexAlgos Club Member at the Website, a legally binding Contract as per the ‘Privacy & Data Protection Policy’ Contract is immediately and automatically entered between You and Us. So, by visiting, accessing, or using the VTC Site, you have indicated that you are at least eighteen (18) years old, and you have the legal capacity to make an offer to enter into this ‘Privacy & Data Protection Policy’ Contract, and giving your full consent to it, which we have also accepted hereby. Thus, your visit or access to the VTC Site, serves as your representation that you have read, understood, acknowledged, accepted, and entered into this ‘Privacy & Data Protection Policy’ Contract, in all manners whatsoever maybe.
VTC Company may modify this ‘Privacy & Data Protection Policy’ Contract at any time, and such modifications shall be effective immediately upon posting of the modified ‘Privacy & Data Protection Policy’ Contract on the VTC Site. And you agree to review the ‘Privacy & Data Protection Policy’ Contract periodically to be aware of such modifications, and your continued access or use of the VTC Site shall be deemed your conclusive acceptance of the modified ‘Privacy & Data Protection Policy’ Contract also, in all manners whatsoever maybe.
This ‘Privacy & Data Protection Policy’ Contract is made only in the English language. If there is any conflict in the meaning of the English language version of this ‘Privacy & Data Protection Policy’ Contract and any version or translation of it in any other language, the English language version shall prevail.

This ‘Privacy & Data Protection Policy’ Contract outlines our practices, and also your acceptance, in relation to the collection, access, storage, use, disclosure, processing, and transfer of personal data to the VTC Site and/or the VTC Company. For this, the ‘Privacy & Data Protection Policy’ Contract sets out the sections as below.
Types of Personal Data:
- Identity Data – this includes title, first name, maiden name, middle name, last name, date of birth, gender, marital status, residential or office address, social security number, and passport or other Govt. issued IDs details.
- Contact Data – this includes billing address, delivery address, email address and telephone numbers.
- Profile Data – this includes your username or similar identifier, and encrypted password, purchases or orders made by you, the VTC Services taken by you. This also includes your occupation, interests, preferences, feedbacks, and survey responses.
- Location Data – Information that is automatically collected via analytics providers or systems to determine your location, including your IP address or domain name and any external page that referred you to us.
- Device Data – Information that is automatically collected about your device including mobile phone, such as, but not limited to, your browser's name, browser plug-in types and versions, time zone setting and location, operating system and platform and other technology on the devices you use to access the VTC Site.
- Technical Data – this includes your means of connection to the VTC Site, and other similar information.
- Log Data – this includes the information generated by your use of the VTC Site that is automatically collected and stored in our server logs, including system activity, any internal and external information related to other websites that you visit.
- Financial Data – this includes your income, details of bank accounts and payment cards.
- Transaction Data – this includes details about payments to and from you, and other details of the VTC Services you have purchased/taken from us.
- Trading Account Data – Information about your connected brokerage trading account including, but not limited to, trading activity, transactions, deposits, withdrawals, and account balances.
- Usage Data – this includes information about how you use the VTC Site and the VTC Services.
- Marketing and Communications Data – this includes your preferences in receiving marketing materials from us and our third parties. This also includes your communication preferences for the same.
- Aggregated Data – such as statistical or demographic data for any purpose, for example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific Website feature.
If you fail to provide personal data, under this ‘Privacy & Data Protection Policy’ Contract, we may have to prevent access to, and/or cancel the VTC Services, that you have availed from us.
We do not collect special categories of personal data. This includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, genetic and biometric data.
Data that is given to us by you –
- when you visit, or sign-up for user/member account on the VTC Site, and/or when you give us your personal data by filling in the website forms like Questions Form, or Support Form, or ContactUs Form, or any other Form, or by corresponding with us by post, phone, email or otherwise, and/or apply for any of the VTC Services,
- when you subscribe to our services or publications, and/or request marketing or other information to be sent to you, and/or enter a competition, promotion, or survey, and/or give us some feedbacks,
- when you purchase any product(s), or subscription(s), or membership(s), or ForexAlgos' BlackBox, and/or the VTC Services, make payments to us, through the VTC Site or otherwise,
Data that is collected automatically –
Cookies - The VTC Company collects data by way of Cookies, Web Beacons, and/or similar technologies, to automatically access your previously stored account information, and/or to deliver more personalised services, and/or interacting with you. For further details, please see, accept, and enter into our ‘Cookies & Similar Technologies Policy’ Contract also.
We will use your personal data for the following purposes:
- to enforce and perform the contracts, we are about to enter into or have entered into with you, by your use of the VTC Site,
- to provide, analyse, and/or improve the VTC Services that you have requested,
- to optimise your experience when using the VTC Site, and/or to deliver personalised services,
- to manage and administer your relationship with the VTC Company, including processing payments, accounting, auditing, billings, collections, and support services,
- to deliver more relevant content and/or third-party advertisements to you,
- to comply with our regulatory obligations including record-keeping, etc.,
- to comply with laws and legal requests from national or international authorities, and/or Courts, including anti money-laundering, export laws, trade sanctions and embargo laws, financial and credit checking, fraud and crime prevention and detection purposes,
- to protect security of the VTC Company and the VTC Community, including IT systems, technology and communication systems, our Website, and/or any Third-Party systems,
- to monitor and determine, compliance with our Terms & Conditions Of Use, Policies, Contracts, and Disclosures,
- to comply with Court orders and establishing, exercising, and defending legal claims,
- If you are a job applicant, for the purpose of processing your job application that you submit to us, directly or via an agent or recruiter speculatively or in response to any advertisement,
- to send you business or marketing communications (such as news about new developments) that we think may be of interest to you unless you have opted out of receiving such communications,
- for Third-Party marketing and/or services,
- to process and assist you with any transactions related to the sale and purchase of the products and/or VTC Services,
- for our internal operations, including troubleshooting, data analysis, testing, research, statistical purposes,
- to monitor and record calls for quality, training, analysis, and other related purposes to improve the VTC Services,
- to respond to your enquiries, requests, feedbacks, or surveys, and/or to send you notifications on your social media platforms.
- for any other purposes for which you have provided your personal data.
Change of Purpose
We will only use your Personal Data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.
Please note that we may process your Personal Data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law. But, if you don’t want us to do the same, request and intimate us through the website forms like Questions Form, or Support Form, or ContactUs Form, or any other Form as available on the website.
We do not have any facility, and do not provide any such service, for sending or receiving private or confidential electronic communications. You should not use the VTC Site to transmit any communication for which you intend only for you and the intended recipient(s) to read. Notice is hereby given that all information and messages and/or other contents entered using the VTC Site can and may be read by the VTC Community and/or any third party, regardless of whether we are the intended recipients of such information and messages. We share your personal data with:
- IT companies and other third parties that provide services or support for the VTC Site and other business systems,
- our professional advisers where it is reasonably necessary to obtain advice or services relating to the operation of our business,
- national and/or international regulators and Govt. authorities,
- with Courts, police, hospitals, law enforcement authorities, regulators or attorneys or other parties where it is reasonably necessary for the establishment, exercise, or defence of legal claims and/or alternative dispute resolution processes,
- with other organisations that provide credit check and money laundering checking services or for other fraud and crime prevention purposes including financial institutions, credit reference agencies and regulatory bodies,
- third party services, such as authentication services for registration and identification purposes.
Access to your user/member account is controlled by your email address, and/or username and an encrypted password, that is unique to you. Also, we store your Data on secure servers, and limit access to your personal data to the VTC Community, and our service providers, and other third parties who have need to know our business.
But, as no data transmission over the internet or data storage system can be guaranteed to be completely secure. The User agrees and acknowledges that, the VTC Company does not guarantee absolute protection and, by accessing the VTC Site, you agree to assume all risks associated with disclosure of personal data and information, arising due to reasons whatsoever maybe, including breach of firewalls and secure server software.

The personal data you provide to us may be transferred to third parties, either within or outside your country of residence, as may be necessary for any of the purposes stated here in the ‘Privacy & Data Protection Policy’ Contract, and/or as may be necessary for the performance of the VTC Services provided to you by the VTC Company.
The place of processing depends on each third-party service provider and the User may wish to check the privacy policy of each of these service providers to identify how much data is shared and why.
We may store and process Your personal information in data centres around the world, wherever our service providers are located. We may store your personal data on servers located anywhere in the world and operated by third party cloud-based service providers such as Amazon Web Services and Google Cloud and others.
The User is aware that in the event the VTC Company goes through a transition, such as a merger. acquisition by another organisation. or sale of all or a portion of its assets. the Users' personal data might be among the assets transferred as a result of the VTC Company transition.
You are hereby aware that personal data may continue to be stored and retained by the VTC Company for the period necessary to carry out the purposes outlined in this ‘Privacy & Data Protection Policy’ Contract unless a longer retention is required under applicable law or until it is no longer necessary for any other legal or the VTC Company purposes (whichever is later).
In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.
Under certain circumstances, you can:
- request access to your personal data. This enables you to receive a copy of the personal data we hold about you, through website forms like Questions Form, or Support Form, or ContactUs Form, or any other Form as available on website.
- request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us,
- request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request. The VTC Site include links to Third-Party information, websites, wordpress plug-ins, apps, and/or applications. Clicking on those links may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements and/or policies. When you leave the VTC Site, we encourage you to read the Privacy Policy/Notices of every website you visit.
You may not transfer any of your rights under this ‘Privacy & Data Protection Policy’ Contract to any other person. We may transfer our rights under this ‘Privacy & Data Protection Policy’ Contract, where we reasonably believe your rights will not be affected.
Wherever possible, each provision of this ‘Privacy & Data Protection Policy’ Contract, as specified from time to time, and including but not limited to this ‘Privacy & Data Protection Policy’ Contract, shall be interpreted in such a manner as to be effective and valid under the applicable laws. However, if any court or competent authority finds that any provision of this ‘Privacy & Data Protection Policy’ Contract (or part of any provision) is invalid, illegal, or unenforceable, that provision or part-provision will, to the minimum extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of this ‘Privacy & Data Protection Policy’ Contract will not be affected. Also, failure by the VTC Company to enforce any of its rights at any time for any period shall not be construed as a waiver of such rights or remedies.

In the event that you experience any issues, misunderstandings, or dissatisfaction related to any aspect of our services or content, we respectfully request that you provide us the opportunity to address and resolve the matter firstly to us, before pursuing through external authorities, legal representatives, or Courts.
As a part of our internal resolution process, upon receiving your communication, please allow us a minimum of 15 calendar days to investigate, respond, and take any necessary remedial steps before considering escalation. This timeframe enables us to ensure a thoughtful and fair review of your concerns.
