Definitions & Interpretation

For the purpose of this Performance Disclosure (the “Performance Disclosure”), the following definitions are used:

1. the terms (the “VTC Company”, “Company”, “Author”, “We”, “Us” or “Our”) shall mean ‘VANITIN Three Commas Private Limited’, incorporated on Date August 23 2018, in India, with the Company Identification Number U93090HP2018PTC007126, and include, without limitations, its respective successors and permitted assigns. Authorized Signatory & one of its Directors, Mrs Vani Sardana, has an alternate Business Address at: #C-35, 2nd Floor, Lane 2, Sector 1, New Shimla, Shimla – 171009, Himachal Pradesh, India. The Company now has its Headquarters in the UK and a Research Office in Switzerland.
2. the term (the “VTC Community”) shall mean VANITIN Three Commas Private Limited, its shareholder(s) or owner(s) or director(s) or employee(s) or agent(s) or licensor(s) or third-party supplier(s), and include, without limitations, their respective successors and permitted assigns.
3. the term (the “VTC Site”) shall mean the Website located at (https://forexalgos.com, and any sub domains), and owned by the Company, VANITIN Three Commas Private Limited, regardless of how you access or use it, including through Desktops, Laptops, Tablets, Mobile Phones, or any other device.
4. the term (the “VTC Services") shall mean any Information, Content, Products, White Papers, Industry Reports, Articles, Editorials, eBooks, Research related Content, Offers, Memberships, Subscriptions, Services, Recommendations, Suggestions or Advice, collectively, within the Website located at (https://forexalgos.com, and any sub domains).
5. the terms (the “You” or “Your”) shall mean You, the viewer(s) or user(s) or subscribers(s) or members(s) or client(s) or licensee(s) or buyer(s)/beneficiaries(s) of “VTC Site” or “VTC Services", and include, without limitations, their respective successors and permitted assigns.
6. the term (the “ForexAlgos’ BlackBox”) shall mean the AI Robotic Trading System/Strategy that generates defined set of trade signals for further use, developed by the Company VANITIN Three Commas Private Limited, and provided as one of its available Services, through the Website (https://forexalgos.com, and any sub domains).

In this ‘Performance Disclosure’ Contract, unless the context requires a different interpretation:

1. the singular includes the plural and vice versa.
2. references to sub-clauses, clauses, schedules, or appendices are to sub-clauses, clauses, schedules, or appendices of this ‘Terms & Conditions Of Use’ Contract.
3. a reference to a person or user includes any person(s), user(s), firm(s), company or companies, government entity or entities, trust(s) and partnership(s).
4. "including" is understood to mean "including without limitation".
5. reference to any statutory provision includes any modification or amendment of it.

Statement

VTC Company may modify this ‘Performance Disclosure’ at any time, and such modifications shall be effective immediately upon posting of the modified ‘Performance Disclosure’ on the VTC Site. And you agree to review the ‘Performance Disclosure’ periodically to be aware of such modifications, and your continued access or use of the VTC Site shall be deemed your conclusive acceptance of the modified ‘Risks Disclosure’ also, in all manners whatsoever maybe.

This ‘Performance Disclosure’ is made only in the English language. If there is any conflict in the meaning of the English language version of this ‘Performance Disclosure’ and any version or translation of it in any other language, the English language version shall prevail.

In trading currencies pairs in the Forex market, people can and often do lose money. No guarantee is or can be given that any system or method will continue to perform similarly in the future. If you have any doubts about trading currencies using any system or method offered here, you should first consult your own financial advisor.

Past performance is not indicative of future results. No investment is risk-free. Therefore, different types of investments involve varying degrees of risk, and there can be no assurance that the future performance of any specific investment product or strategy, or system (including the trading systems or strategies undertaken by the ForexAlgos’ BlackBox), or any non-investment related content, made reference to directly or indirectly on VTC Site will be profitable, equal any corresponding indicated historical performance level(s), be suitable for your individual situation, or prove successful.

All performance claims found on the VTC Site about the ForexAlgos’ BlackBox itself or trading systems, and/or trading strategies used to build ForexAlgos’ BlackBox must be regarded as hypothetical. And use of VTC Services and ForexAlgos’ BlackBox indicates that you know, accept, and fully agree to this Performance Disclosure. Before using ForexAlgos’ BlackBox or any systems or strategies listed on VTC Site, you should be completely aware that:

1) There is often a vast difference between hypothetical results and real-life trading results achievable in a real brokerage account, and real-live results are almost always vastly worse than hypothetical results. Performance results for ForexAlgos’ BlackBox or any systems or strategies listed on VTC Site do not consider the fees, spreads and/or trading commissions that may be charged by your broker. Please consult with your broker for information on these costs.

2) Hypothetical performance results have many inherent limitations, some of which are described below. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown. In fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program. One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk in actual trading. For example, the ability to withstand losses or to adhere to a particular trading program in spite of trading losses are material points which can also adversely affect actual trading results. There are numerous other factors related to the markets in general or to the implementation of any specific trading program which cannot be fully accounted for in the preparation of hypothetical performance results and all of which can adversely affect actual trading results.

3) The method of resetting the model account to the suggested capital amount at the start of each week creates a track record which is representative of the simple returns for each time period, but that it does not, by definition, show how returns would compound over time. Should an investor following any trading system listed within this website trading a single contract indefinitely without also resetting their account to the initial capital amount each month, their performance will differ from the performance detailed herein.

The information contained within the VTC Site is provided with the objective of “standardizing” trading system’s account performance. It should not be viewed as a solicitation for the referenced trading systems. As past performance does not guarantee future results, these results may have no bearing on, and may not be indicative of, any individual returns realized through participation in this or any other investment. The statistics on the VTC Site are calculated via the combination of three hypothetical data sets:

1. Backtested - Backtested performance is calculated by running a trading system backwards in time and seeing what trades would have been done in the past when applied to back adjusted data.
2. Tracked - Tracked performance is calculated by running the trading system forwards on data each and every day and logging the trades as they happen in real time day after day. Live performance is calculated by running the trading system on live tick data for actual clients and tracking the actual buy and sell prices those clients trading the system receive in their account.
3. And where available Live - We use Live results to calculate monthly returns for any month in which clients were trading for the entire month, tracked fills for those months in which there are no client fills for the entire month, and computer-generated fills for those months occurring before we loaded the system onto our trade servers. The results are hypothetical in that they represent returns in a model account. The model account rises or falls by the single contract profit and loss achieved by the system in whichever data set is available. The hypothetical model account begins with the Suggested Capital listed and is reset to that amount each week. The percentage returns reflect inclusion of commissions, fees, slippage, and the cost of the system. The commission, slippage, fees, and monthly system costs are subtracted from the net profit/loss prior to calculating the percentage return.

Please note that the method of resetting the model account to the initial value at the start of each month creates a track record which is representative of the simple returns for each time period, but that it does not, by definition, show how returns would compound over time. Should an investor following said program trade a single contract indefinitely without also resetting their account to the initial capital amount each month, their performance will differ from the performance detailed herein.

The trading system performance data on this website may change at any time without warning due to several circumstances, including but not limited to refreshes of market data used to calculate system signals, upgrades, or changes to the system code by its developer, changes to the minimum investment amount, commissions, or slippage estimates, and more. The actual percentage gains/losses experienced by investors will vary depending on many factors, including, but not limited to, starting account balances, market behaviour, the duration and extent of investor participation (whether or not all signals are taken) in the specified system, and money management techniques.

Also, you are aware and accept the risks arising from the replication of investment strategies of the ForexAlgos’ BlackBox as used here. Also, client may not be able to follow all of the signal trades generated due to the client’s account having insufficient funds. Accordingly, the performance of client accounts may vary significantly from the results portrayed on the VTC Site.

The VTC Company do not make any representation whatsoever, that the above-mentioned trading systems or strategies might be or are suitable or that they would be profitable for you. Please realize the risk involved with trading Forex investments and consult an investment professional before proceeding. The trading systems and strategies herein described have been developed for sophisticated traders who fully understand the nature and the scope of the risks that are associated with trading. Should you decide to copy-trade, and/or connect to ForexAlgos’ BlackBox’s trade signals, it is completely your own decision and responsibility.

There is no guarantee that your hypothetical trading results, even if tested against historical data, will produce comparable actual trading results. Thus, we do not guarantee that the use of the VTC Site will have a positive result or a specific performance for you. Any references to the performance of transactions carried out by our user(s) and/or member(s), are related exclusively to the past. Any reference to the performances of the ForexAlgos’ BlackBox, may not take into account the costs of transactions, such as Broker fees or any other fees applicable to your Brokerage Account, or any other.
